High court refuses to overturn order stopping rte airing denis o'brien details

A High Court judge has refused to overturn an order stopping RTE airing details of Denis O'Brien's banking arrangements with IBRC. RTE had argued that the order no longer serves any purpose because the information is already in the public domain and should not be held as a 'sword of Damocles' over the media. The businessman's lawyers said he no longer sought to prevent the broadcast in the wake of Dail comments by TDs Catherine Murphy and Pearse Doherty. However they argued the order extends beyond the proposed script to confidential information in RTE's possession. Mr Justice Donald Binchy has refused to vacate the order over concerns by IBRC that RTE would be in a position to publish information disclosing legal advice the bank received. There will be further submissions on Wednesday about varying the temporary injunction.
